Event Visionary (referred to as "we," "us," or "our") provides a marketplace ticketing solution for event organizers and ticket purchasers (collectively referred to as "Users" or "you"). By using our website and services, you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use our services.
2. Ticketing Services
2.1 Ticket Sales
a. Event Visionary acts as a platform for event organizers to list and sell virtual tickets for their events.
b. Event organizers may choose to charge sales tax through our platform, and we will collect and remit such taxes on their behalf.
2.2 Purchase and Delivery
a. When purchasing tickets through Event Visionary, you agree to the event-specific terms and conditions, including refund and cancellation policies, set by the event organizer.
b. All ticket sales are virtual, and tickets will be delivered electronically via our platform.
2.3 Taxes
a. Event Visionary collects and remits sales tax on behalf of event organizers who have elected to charge sales tax through our platform.
b. Event organizers are responsible for accurately setting the sales tax rates and complying with applicable tax laws.
c. Event purchasers may be required to pay applicable taxes.
2.4 Refunds and Cancellations
a. Refund and cancellation policies are determined by event organizers and are subject to their discretion.
b. Event Visionary facilitates communication between event organizers and purchasers for refund and cancellation requests.
3. Event Organizers
3.1 Event Listings
a. Event organizers are responsible for creating and maintaining accurate event listings, including event details, ticket availability, and pricing.
b. Event organizers must ensure that their events comply with all applicable laws and regulations.
3.2 Ticket Sales
a. Event organizers set ticket prices and determine ticket availability. They may also choose to charge sales tax through our platform.
b. Event organizers are responsible for complying with tax laws and reporting sales tax collected.
3.3 Payment and Settlement
a. Event organizers agree to the payment terms and fees outlined in our separate Event Organizer Agreement.
b. Event Visionary will facilitate the settlement of ticket sales revenue to event organizers in accordance with the agreed-upon terms.
3.4 Age Restrictions
a. Event organizers are responsible for accurately specifying the age restrictions for their events.
b. Event organizers must ensure that their age restrictions comply with all applicable laws and regulations.
c. Event Visionary reserves the right to suspend or terminate the account of any event organizer who inaccurately specifies age restrictions for their events.
3.5 SMS Campaigns Feature
a. Event organizers may choose to use Event Visionary's SMS campaigns feature for an additional cost.
b. Event organizers are solely responsible for the content and conduct of their SMS campaigns, ensuring compliance with all applicable laws and regulations, including anti-spam laws.
c. Event organizers must obtain the necessary consent from recipients before sending SMS messages.
d. Event Visionary reserves the right to monitor SMS campaigns for compliance with our policies.
3.6 Abuse of SMS Campaigns
a. Event organizers must not engage in the abuse of the SMS campaigns feature. Abusive behavior includes but is not limited to:
- Sending unsolicited or spammy messages.
- Sending messages that violate the rights of others.
- Sending messages that contain harmful or offensive content.
- Sending messages in violation of any laws or regulations.
b. Penalties for abuse may include:
- Suspension or termination of the event organizer's account.
- Imposition of fees and charges for abuse-related investigations and corrective actions.
- Legal action in cases of severe abuse.
3.7 Compliance with SMS Laws
a. Event organizers using the SMS campaigns feature must comply with all applicable SMS and telecommunication laws, including but not limited to the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act.
3.8 Indemnification
a. Event organizers agree to indemnify and hold Event Visionary harmless from any claims, liabilities, damages, or expenses arising out of or related to the misuse or abuse of the SMS campaigns feature.
4. Liability and Disclaimers
4.1 Limitation of Liability
a. Event Visionary is not liable for disputes, issues, or losses arising between event organizers and ticket purchasers.
b. We are not responsible for the quality, safety, or conduct of events listed on our platform.
4.2 Disclaimer of Warranties
a. Event Visionary provides services "as is" and makes no warranties or representations regarding accuracy, completeness, or reliability.
b. We do not guarantee the availability, security, or uninterrupted operation of our website and services.
5. Intellectual Property
5.1 Ownership
a. Event Visionary owns all rights to its website, content, and services.
b. Event organizers retain all rights to their event listings and associated content.
6. Termination

a. Event Visionary reserves the right to suspend or terminate User accounts or access to the platform for violations of these Terms or other reasons.
7. Governing Law and Jurisdiction

a. These Terms are governed by the laws of Wyoming and the United States, without regard to conflicts of law principles.
b. Any legal action arising from these Terms shall be brought in the state or federal courts located in Wyoming, and you consent to their jurisdiction.
